Rwanda: Arrestation de Félicien Kabuga. Historique d’un dossier judiciaire controversé!

L’arrestation de Félicien Kabuga, le 16/05/2020 à Paris, a fait la Une de bon nombre de journaux du monde et la nouvelle est partagée abondamment sur les réseaux sociaux.Mis en accusation il y a un quart de siècle, les charges qui pèsent sur Kabuga Félicien se sont peu à peu effondrés et le dossier judiciaire s’est dégonflé au vu des éléments nouveaux apparus au tout au long de ces 25 ans et qui permettent d’éclaircir certaines zones d’ombre du génocide rwandais.

Félicien Kabuga, un self-made-man devenu millionnaire

Né en 1932 en commune de Kiyombe, dans la préfecture de Byumba au Rwanda, M. Félicien Kabuga a débuté son commerce à l’âge de 18 ans, sans aucun capital et sans aucune formation. Il n’a fréquenté aucune école. Il a constitué son premier capital en vendant au marché local les corbeilles qu’il tissait lui-même. Ensuite, il s’est lancé dans le troc du sel  contre le café et les produits vivriers. En 1956 il a obtenu son registre de commerce et a ouvert un magasin de commerce des biens de première nécessité notamment les outils agricoles. En 1959 il s’est marié avec Josephine Mukazitoni (+). Jusqu’en 1973, il est resté dans le centre de négoce de Rushaki proche de la frontière rwando-ougandaise, ce qui lui permettait d’étendre sa clientèle aux Ougandais frontaliers.

Kabuga Félicien

Ce n’est qu’en 1973, après déjà vingt années d’activités, qu’il s’est installé dans la capitale Kigali où il venait d’achever la construction d’une maison à deux niveaux qui lui servait à la fois de résidence et de lieu de travail. Il a poursuivi ses activités commerciales en achetant, sur place, à des grossistes, des produits importés qu’il revendait au détail. Après avoir accumulé des fonds nécessaires et analysé le marché, il a décidé d’étendre son activité à l’importation. Il a commencé par la friperie (vêtements de seconde main) qu’il importait de Hollande (Simon Spayer), des Etats-Unis (Galaxy Ltd, United Ltd, Mara Ltd) et de Belgique (Mandere).

Au fur et à mesure de l’expansion de ses affaires, il a diversifié ses marchandises en important d’autres produits tels que des luminaires, des tôles, du lait en poudre, des appareils électroménagers, des outils agricoles, des produits alimentaires,… Quelques années plus tard, il a investi dans d’autres secteurs tels que le transport, les plantations de thé, l’industrie, l’immobilier et les banques. Au 6 avril 1994, il possédait plusieurs biens et notamment:

–des dépôts de blé, de farine et de différentes marchandises de plusieurs millions de dollars
–une quarantaine de camions de transport international

–une plantation  de thé de plus de 350 hectares à Mulindi

–une minoterie d’une capacité de plus de 39.000 tonnes de blé par an dans la ville de Byumba

–plusieurs immeubles à Kigali dont un entrepôt de marchandises à Gikondo, des maisons d’habitation dans divers quartiers de la capitale et un complexe immobilier à Muhima qui devait comprendre un hôtel-restaurant, des bureaux, des espaces de location, un supermarché. L’immeuble était déjà équipé en bureaux, télévisions, lits etc.

Il détenait également des actions de plusieurs sociétés:

– la Banque Commerciale du Rwanda (BCR)

– la Banque Continentale Africaine du Rwanda (BACAR)

– la Rwandaise : Société rwando-européenne d’importation et d’entretien des véhicules de marque Mercedes, rebaptisée Akagera Motor par ceux qui se la sont appropriée

– la  Société de Transport International du Rwanda (STIR)

– la Radio-Télévision Libre des Mille Collines (RTLM).

Destruction, pillage et appropriation des biens meubles et immeubles de la famille Kabuga par le régime du FPR

A la reprise de la guerre, le 6 avril 1994, l’armée du Front Patriotique Rwandais (FPR) a démoli, à la dynamite, la résidence de la famille Kabuga qui était située dans le quartier de Remera. Après la prise du pouvoir par le FPR, ce dernier et son régime se sont livrés au pillage de ses biens et autres escroqueries. Il a vidé toutes les marchandises qui se trouvaient dans les entrepôts de Byumba, de Muhima et de Gikondo. Il a démonté les machines de la minoterie de Byumba et il les a vendues en Uganda après les avoir exploitées pendant au moins deux ans et après avoir épuisé les immenses stocks de blé évalués à 3.242.000 US. Finalement, l’Etat rwandais a décidé de vendre ce qui restait de la minoterie de Byumba à une entreprise kenyane Pembe Flours Mills Ltd.

Le reste des est exploité gratuitement par l’Etat rwandais et les dignitaires du FPR. Ainsi, les plantations de thé situées à Mulindi et à Nyange d’une superficie de plus de 350 hectares ainsi que les maisons d’habitation qui y sont construites sont exploitées pour le compte du ministère de la défense. Le complexe de Muhima de 120 chambres, 80 bureaux et d’autres locaux destinés à diverses activités commerciales et administratives abrite les services du FPR, du gouvernement et des institutions internationales. Ces dernières versent le loyer au FPR. Le  régime y loge aussi, gratuitement, des membres des dignitaires du FPR. A Remera et à Kimihurura, quartiers de la capitale, les maisons résidentielles de la famille sont occupées par des protégés du régime. Les entrepôts de Gikondo sont utilisés comme prison.

Les comptes bancaires n’ont pas été épargnés. Des dépôts équivalents à 400.000 Euros ont été subtilisés et pour rétablir l’équilibre comptable des institutions bancaires concernées, les comptes créditeurs de la famille ont été changés en comptes débiteurs, ce qui est un double vol. Quant aux actions dans diverses sociétés (BACAR, BCR, STIR, La RWANDAISE), elles se sont volatilisées et personne n’en parle.

Toutes les démarches que la famille a entreprises auprès des autorités rwandaises pour  récupérer ses biens se sont soldées par un échec. Elle a décidé d’envoyer au Rwanda le fils aîné de M. Kabuga, muni des procurations nécessaires, pour réclamer la restitution des biens. Il y a été reçu par l’ex-procureur général Gerald Gahima ainsi que par de nombreux autres fonctionnaires. Ses interlocuteurs lui ont exigé de reconnaître, au préalable, que M. Félicien Kabuga a commis le crime de génocide, de renoncer à la réclamation des revenus passés et d’accepter les immeubles et les plantations de thé dans leur état actuel. La famille n’a évidemment pas souscrit à ce vicieux marchandage. Le représentant de la famille est rentré dans son pays d’asile sans avoir rien obtenu.
